WWFL Fined For Failure To Respond        5-9-14
The FCC has fined Onda Mexicana Radio Group $8,000 for "failing to fully respond to a Notice of Violation." The fine against WWFL-AM 1340 follows a notice in January of the proposed fine which the FCC received no response. The case began in 2012 when the Tampa office of the FCC’s Enforcement Bureau issued a Notice of Violation to Onda Mexicana for violations found during inspections. The commission says Onda Mexicana didn’t submit a response.
Follow-up; The original violations included a lack of proper fencing, lack of station log, lack of Public File, lack of Chief Operator, lack of EPM, and studio location not as authorized. The owner claims he eventually responded to the Tampa office, but the FCC says it was not complete and not sent where he was told to respond.

WELE Donation To Bethune Cookman University OK'd         5-15-14
The FCC has conditionally granted the renewal of the license of WELE-AM 1380. From the FCC documents; "...the Station has had an exceptionally troubled history in the last several years. F. Douglas Wilhite (“Wilhite”), the sole shareholder of the Licensee, was convicted in 2010 of two felonies (child abuse and neglect of a child causing great bodily harm). The Licensee went into bankruptcy in 2011 and emerged from bankruptcy in 2012. The Licensee also faced a litany of complaints of consumer fraud, leading to a civil penalty for violations of the Florida Sellers of Travel Act in 2010. In light of Wilhite’s criminal record, we cannot make a determination that Wilhite and the Licensee are qualified to hold, or assign, the Station’s license. However, compelling public interest determinations support actions that will allow a donation of the Station’s license and related assets to Bethune-Cookman University (the “University”). Wilhite will derive no financial benefit from the donation. Our action here will result in Wilhite’s full withdrawal from broadcasting and will ensure that the Station may operate in the public interest under the University’s control. Accordingly, we will follow Commission precedent that finds that such public interest considerations support a grant of an assignment application where a character issue is resolved against a licensee or is pending. And while Wilhite's felonies would normally make renewals subject to a hearing to determine his qualification to hold a license. The donation to the college and Wilhite's withdrawal from ownership with no compensation led the Commission to grant the renewals with the condition that Wilhite not benefit from the transfer.
